Yes. Australia recognises same-sex relationships for all Partner Visa subclasses (820/801 and 309/100). You must be in a genuine and ongoing relationship, and meet the usual eligibility criteria—whether you’re married or in a de facto relationship. However, sponsorship approval is subject to character checks. A sponsor with a significant criminal record, especially involving offences against children or family violence, may be barred or refused from sponsoring a partner. The Department of Home Affairs carefully reviews these cases before granting sponsorship approval.
-
Yes! You can apply for a de facto partner visa if you've been in a genuine relationship for at least 12 months. Exceptions may apply for compelling circumstances or if you have children together. Our team can assess your specific situation during your free consultation.
-
Previous sponsorships can affect eligibility, but waivers may be available. Generally, sponsors must wait 5 years between partner visa sponsorships and can only sponsor 2 people in their lifetime. Our immigration lawyers specialize in complex cases and can advise on waiver applications if needed.
-
If your relationship ends before the permanent visa is granted, your application may be affected. However, exceptions exist for family violence situations or if you have children together. We provide honest advice about your options in difficult circumstances.
-
Yes! If you apply for an onshore partner visa (820) and hold a substantive visa, you'll receive a Bridging Visa A that allows you to work, study, and access Medicare while your application is processed. Offshore applicants (309) must wait until their visa is granted.
-
Our fees are transparent and depend on your specific circumstances. During your free consultation, we'll provide an upfront quote with no hidden costs. Government application fees are separate (currently around $8,850 AUD). Many clients find our peace of mind guarantee offers exceptional value with free re-applications if needed.
