WHAT THE OFFICIAL GUIDANCE ESTABLIESHES

Sponsorship obligations continue after approval

Home Affairs says approved sponsors must meet ongoing obligations and notify relevant changes. Employers must also comply with Australian workplace laws.

Current official position checked 21 August 2026: Home Affairs identifies possible sanctions for failures to meet sponsorship obligations, including sponsor cancellation or bars, infringement notices, court-imposed civil penalties, compliance notices and enforceable undertakings. Home Affairs also directs sponsors to report certain worker or business changes, including specified changes within 28 days. Individual obligations and deadlines require legal review.
Important: A changed payment, duty, location or entity does not automatically prove a breach. The approvals, nomination, contract, payroll, actual work and notification history must be examined together.

THE CORE CHALLENGE

Many Employers Get Sponsorship Approval. Few Build A Compliance System.

A sponsored worker’s visa approval confirms the position at the time of application. However, businesses change. Employees move locations. Duties evolve. Payroll systems change. Companies restructure.

Without proper processes, employers may unknowingly create inconsistencies between:

  • Approved nomination details

  • Employment contracts

  • Payroll records

  • Actual workplace arrangements

  • Required notifications

A compliance health check helps identify these gaps early.

WHY COMPLIANCE MATTERS

The Risk Is Not Sponsoring Workers. The Risk Is Losing Control Of Your Sponsorship Obligations

Employer sponsorship requires ongoing management.

Common issues employers need to monitor include:

✓ Worker salary and payment records
✓ Position duties matching the approved occupation
✓ Work location changes
✓ Employment entity changes
✓ Record keeping obligations
✓ Notification requirements
✓ Sponsorship expiry and workforce planning

A proactive review gives your business visibility before an issue escalates.
