    Financial Dependency
    If the child is aged 18 to 25, they must demonstrate financial dependency on the sponsoring parent.

    Current Location Requirement
    The child must be in Australia at the time of the visa application and while the visa is being processed.

    Health and Character Requirement
    The child must meet Australia's health and character requirements.

    Parental Responsibility
    In cases of separated parents, evidence of legal responsibility or custody must be provided.

  • For orphaned children or those whose parents cannot care for them, allowing them to live with a relative who is an Australian citizen or permanent resident.

    To be eligible for the subclass 837 Orphan Relative Visa, the following criteria must be met:

    Sponsorship
    The child's sponsoring parent must be either an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.

    Parental Care
    The child must prove that his/her parents are either:
    - Deceased
    - Permanently incapable of caring for the child
    - Whereabouts are unknown

    Consent to Migrate
    For children under 18:
    - Written consent is needed from everyone with legal rights over where the child lives.
    - The home country's laws must allow the child to leave.
    - It must follow any Australian court orders about the child.

    Visa Holder
    A child may not get this visa if:
    - They don’t currently hold a substantive visa.
    - They didn’t apply within 12 months of their last substantive visa ending.
    - Their last or current visa is a Subclass 771 Transit visa.

    Current Location Requirement
    The child must be in Australia at the time of the visa application and while the visa is being processed.

    Health and Character Requirement
    The child must meet Australia's health and character requirements.

    Age
    The child must be under 18 years old, or between 18 and 25 if financially dependent on the parent, or over 18 years old with a disability that prevents them from working.

  • A temporary visa for children outside Australia who are dependent on their Australian parents, allowing them to live here while awaiting permanent visa.

    To be eligible for the Subclass 445 visa, the following criteria must be met:

    Dependent Child

    The applicant must be the biological, adopted, or stepchild of a parent who holds a temporary Partner Visa (Subclass 309 or 820).

    Age Requirement

    The child must be under 18 years of age. However, applicants over 18 but under 23 may also qualify if they are financially dependent on the parent.

    Parental Relationship

    The child’s sponsoring parent must hold a valid temporary Partner Visa and have applied for a permanent Partner Visa.

    Sponsorship

    The sponsoring parent must agree to sponsor the child for this visa.

    The adoption must have been arranged by a competent authority in the child’s home country, or the adoption must be under the Hague Convention on Intercountry Adoption.

    The child must have an eligible adoptive or prospective adoptive parent as their sponsor.

    Age

    The child must be under 18 years of age at the time of application.

    Location

    The child must be outside Australia when the visa application is lodged and when the visa is decided.

    Health and Character

    The child must meet Australian health and character requirements. The adoptive parents may also need to undergo character checks.

    Adoption Approval

    If the adoption was not arranged by an Australian state or territory adoption authority, the Department of Home Affairs will assess whether the adoption meets the requirements.
